Manitoba’s new requirements for washroom access

Manitoba has passed the “Access to Washrooms for Delivery Persons” Act, a new Workplace Safety and Health requirement that as of May 30, 2023 requires owners of a workplace to provide access to washroom facilities to a delivery person attending the workplace for the purposes of collecting or making a delivery.

The mandated access is not required if the owner can demonstrate that access would pose a risk to the safety or health of any person in the workplace, cause undue hardship due to the activities in the workplace, the security requirements, and the layout of the workplace; or the washroom is only accessible via a residence.  During the early stages of the pandemic, this issue was a common discussion point in media and was the impetus for the creation of this legislation.
