Federal Plastic Ban Appeal Advances
July 9, 2024Attention all retailers and manufacturers who manage products with plastics: On June 25, 2024, Canada’s Federal Appeals Court reviewed the Federal Government’s appeal against the November 2023 ruling that deemed the listing of all plastic manufactured items (PMI) as “toxic” under schedule 1 of the Canadian Environmental Protection Act (CEPA) overly broad. This listing is the basis that supports actions such as Canada’s Single Use Plastic Ban (SOR/2022-138). The ruling also challenged federal overreach on provincial matters. A decision on the appeal is expected this fall, with a potential Supreme Court review to follow. The stay on the case upholds the plastic ban for now.
