Competition reforms and Digital Services Tax – Federal Bill C-59

Federal Bill C-59, the Fall Economic Statement Implementation Act, 2023, proposed a new Digital Services Tax (DST) as well as comprehensive reforms to the Canadian Competition Act. RCC raised several concerns about the DST, including its retroactive application and Canada’s decision to proceed with it alone despite ongoing international negotiations.

Bill C-59 also proposed significant reforms to the Competition Act, which would follow those passed recently in Bill C-56. RCC raised concerns generally about the fast pace of these reforms and commented on several proposed changes, including right to repair, drip pricing and expanded private rights of action.

C-59 has been moving at a fair pace through Parliament.
