BC Temporary Layoff Provision: Employers wanting extension beyond August 30, 2020 should apply by August 25, 2020

BC has a variance process for those wishing to extend their COVID-19-related layoffs beyond August 30, 2020 when the COVID-19 emergency layoff is set to expire. Recognizing that not all sectors are yet in a place to recall all employees, employers and workers will be able to jointly apply to the Employment Standards Branch for a temporary layoff variance. More information on the variance program is here, the application form is available here. Employers must survey their workforce to obtain more than 50% support from workers before applying. Workers will receive information about the variance, including what their rights are and can provide their support using a new online response tool. To ensure applications are completed by the August 30, 2020 deadline, employers are encouraged to submit their variance application by August 25, 2020.
