B.C. legislation to clarify paid sick leave by calendar year

Following extensive input from RCC and other business associations, the Minister of Labour introduced a bill late on Monday, March, 28, 2022 amending the Employment Standards Act to reference “calendar year,” rather than “employment year”, simplifying the annual entitlement period for all employees regardless of the start of their employment.

The amendment also addresses entitlement for those employees with collective agreements to ensure that they receive five full paid sick days. The changes will not be effective until the amendment bill has received Royal Assent, but given the nature of this government legislation from a majority government we expect it will pass easily and quickly.
